To the Registrar appointed by Act of Parliament for the Registry of deeds and asforsh ???? deed becoming date the thirteenth day of February one thousand seven hundred and ninety six between Elizabeth Edkins and Wills Widow of John Edkins of the City of ? ? ? lately deceased and daur of Joshua Wills of the same City Gent of the first part and Elizabeth (read Joshua - Ed) Edkins (the son of?) the said Elizabeth of the said City of Dublin Gent of the second part Thos Ramage of the said City Esq of the third part and Edwd Litton of Glaminin in the county of Dublin Esq the only son and heir at law of Thomas Litton late of the City of Dublin Esq who was ? of Trustee named in the last Will and Testament of the said Joshua Wills late of the City of Dublin Gent decd of the fourth part reciting as in said deed of ? also reciting that said Eliz Edkins was under and by virtue of the last Will of the said Joshua Wills her late Father bearing date the Twenty fourth day of June one hundred seven hundred and fifty six Entitled (among others) to one full undivided third part of the clear yearly Rents and profits of certain Honey? Tenomt and premises situated in Thomas Street Frances Street Vicar Street and Hanover Lane, which said premises are situate lying and being in the County of the City of Dublin, but Subject as in said deed pairly mentd also reciting of the ???? bearing date the third day of December 1791 made between the said Elizth Edkins of the first part Ann Edkins one of the children and the only daur of the said Elizth and since decd of the other part Robt Howes of the City of Dublin Gent of the third part and Thomas Ramage of the City of Dublin Gent of the forth part Reciting to the Effect therein recited / also reciting that a marriage was intended to be had and ? between the said Robert Howes and the said Ann Edkins and that the said Elizth being desiring to make a provision for said Ann Edkins in pursuance and by ? land in Exion of the powers vested in her by the Will of the said Joshua Wills as therein recite in case and intended marriage should take effect she said Elizth in ? of said intended marriage so to be had and solomised And for the purpose of making some provn for the issue of said marriage and for other consideration and purposes therein mentd did grant bargain sell release and confirm unto the said Thomas Ramage his actual profs then being by of a bargain and sale to him thereof made for one whole year by ? bearing date the day next before the date of said presents and by force and virtue of the ?? forhams? uses unto the pofsn and to his heirs all her the said Elizth one third part of the said house Tenemk and premises situated in Thomas Street Frances Street Vicar Street and Hanover Lane afd with the rights members provs & ? belonging or appent ? in as full and ample manner as the said Elizth Edkins had a right to hold and enjoy the same and one third part of all other buildings and ? made or so be made thereon and the Reon & Red? and renewable right and benefit of renewal rents issues and profits thereof To hold all and ? said one undivided third part of said last mentd Houses Tenom and premises and every ? and ?? with their appendices unto the said Thos Ramage and his heirs Henceforth forever provided that rights of said Eliz Edkins therein should so long last upon Trust ? and to and for the ? use ?? purposes whatr and upon this further Trust and confidence and to the intent that from and imm by after the Ex? of said ? that the said Thos Ramage and his Heirs ? and permit and suffer the said Ezth Edkins and her assigns for and during the term of her natural life to receive and take to her and her own use and ? benefit All that and those the Rents issues and profits of all and singular one undivided third part of the said premises situated in Thomas Street Frances Street Vicar Street and Hanover Lane aforesaid and upon this further third that if the said Ann Edkins should survive the said Elizth and the said intended share should take effect then and in such case to permit and suffer the said Ann Edkins to receive and take out of the Rents issues and profits of the said one undivided part of all and singukar the said premises situate as aforesaid the clear yearly sum or annuity of fifty pounds ? during the term of her natural life subject to the conditions ? and Elizth therein mentd with power of distress in case of nonpayment thereof with ? over to the said Rob Howes in case he should survive the said Ann Edkins during the term of his natural life ? to the child or children of said intended marriage lawfully to be begotten and in case there should be more than one to be enjoyed by them in common not as joint tenants subject however to the several conditions restrictions and ? in said deed fairly mentioned and in case such child or children should die in the life time of the said Robt Howes before the eldest should attain the age of twentyone years then the said annuity to which the said one undivided third share of said premises is liable to said Robt Howes his heirs and assigns forever with ? for first ? and it was also provided and agreed by said ? that nothing therein contd should provision of said Ann Edkins from renew of the entries rents and profits of said one undivided third part of said premises ?????? distribution or disposition of the residue and ? of the ? and profits of said ???? said premises over and above the said annuity of fifty pounds granted as aforesaid ???? the powers vested on said Elz by the said Will of the said Joshua Wills also ??? take effect and that there are issued having said mar one son and one daur name by John ? Wills ? Howes and Elzith Sarah Ann Howes that said Thomas Litton ??Joseph ?of said Thos Litton also decd and said Edwd Litton is his heir at law that said Elizth Edkins ?was ? entitled to one full undivided third part of the clear yearly rents issues and profits of said premises situated as before and in said part recited under part mentd subject after her death as therein before stated ? said annuity or yearly rent charge granted as afd to said Robert Howes and issues of said marriage under the sevl restrictions ? and limitations therein mentd and reciting that the said Elizth being desireous to make a provision for her son the said Joshua Edkins in pursuance by virtue and in Exion of the provision vested in her by the said Will of the said Joshua and to make a provision ?issue of said Joshua to be there after lawfully begotten the said ? witnessed that for ?? therein mentd the said Elizth Edwd Litton did grant ? sell alienate release and confirm unto the said ? Ramage in his actual profn then being by ? of a Baigaui and sale to him thereof made by ? date the day next before this day of the date of said presents and by force and virtue of the statute for ?uses into ? and to his heirs All her said Elzth said one undivided third part of the said houses tenements and premises situated in Thomas street, Frances Street, Vicar Street and Hanover Land as aforesaid with the ? in as ample a manner as said Elizth Edkins had a right to hold and enjoy the same and one undivided third part of all other buildings and improvements ? to be made on the said premises respley and the Reo? And Rev? R? and renewable right and benefit of renewable rents issues and profits subject howr as aforesaid To hold to the said Thos Ramage and his heirs henceforth forever provided that ? of the said Elizth Edkins should so long Contained subject as aforesaid to said annual or yearly rent charge of fifty pounds yearly ? and appointed by said ? in part recited ? thereby satisfied and confirmed and provided that nothing therein contained should be ? to affect said ? or said annuity of fitly pounds thereby ? and appointed but that the whole of said one undivided third part of said premises should be ? us the ? instance after the death of said Elixth to the payment thereof and that the person or persons entitled to ? the same under and by virtue of the limitation ? the said ? shall have the same right benefit priority and prcidence as if said deal never had been made upon trust never? And to and for the ? uses and purposes therein mentioned that is to say after the Exon of said deed said Thomas Ramage and his heirs should permit and suffer said Joshua Edkins and his ??? own uses out of the rents issues and profits of said ? [cannot read] Sum of fifty pounds ? for and during the term of natural the ? to be payable half yearly on ? first day of May and first day of November in every year during ? of the said Joshua the first payment be made on the first day of May next ensuring the date of the said presents with ? of distress in case of non payment with power to said Joshua to settle And fifty pounds yearly on a Wife during her life and in case there shall be issue of the Body of said Joshua lawfully begotten to suffer such child or children form and name / after the death of said Joshua in case she shall not make such appointment for the benefit of his said wife and after the death of any taken after Wife of said Joshua so ? in case he should make such appointment to receive and take to said child or children said yearly sum of fifty pounds clear out of the rents issues and profits of said houses and premises situated as aforesaid to be enjoyed by them as tenants in common and no as joint tenants if more than one child in such props? As said Joshua should be deed or will direct and aff? And for? Of such appointment to be divided between them if more than one and if only one child to be enjoyed by such one child and his or heir Heirs of assigns and if no child or children of said Joshua living at the time of his death or that such child or children lawfully begotten living at the death of said Joshua that? die before the eldest shall attain the age of twentyone years that then said Thoms Ramage and his heirs shall convey all and singular said yearly sum or annuity of fifty pounds clear which said one undivided third par of said houses tenements and premises situate in Thomas Street, Francis Street, Vicar Street and Hanover Lane is thereby subject after the death of said Joshua and upon the death of such issue if any as aforesaid to George Edkins the only brother of said Joshua and to John Percy Wills Gage Howes and Elizth Sarah Ann Howes and Ann Shea the only sister of said Elizth Edkins and the heirs of their ? bodies in such shares and proproptions as said Joshua Edkins shall by deed or will duly executed direct and appoint and in failure of such issue of said respec? Bodies of said George Edkins John Percy Wills Gaye Howes and Elz Sarah Ann Howes and Ann Shea then To Benjamin Wills of Paradise Row city of Dublin and only nephew of said Joshua Wills said testor his Heirs and assigns for ever at the costs and charges of such heirs and assigns and provided always that nothing In said presents should deprive or be a ban to said Elizth Edkins from receiving the residue and ? of any There shall be of the full and entire rents issues and profits of said one undivided third part of said premises During her life in manner aforesaid or from making such a dispoisitory or distribution of the ? and ? of The rents and profits of said and undivided third part of said premises if any there shall be over and above Said thereby granted yearly sum or annuity of fifty pounds ster also over and above the said yearly Sum or annuity of fifty pounds ster granted by said therein before in part recited deed by will or one Of said Elizth Edkins or shod or might think proper pursuant to the provisions authy so vested in her by said Will of said Joshua Wills any thing therein entitled to the contrary thereof not ? to which and deed and this ?
